Welcome to Tempesta Artisan Salumi. These Terms & Conditions (“Terms”) apply to tempestasalumi.com (the “Site”) and to every order you place with [LEGAL ENTITY], doing business as Tempesta Artisan Salumi (“Tempesta,” “we,” “us”). By using the Site or placing an order, you agree to these Terms and to our Privacy Policy and Shipping, Refunds & Returns Policy, which are part of them.
You must be 18 or older to place an order. We ship only to street addresses in the 48 contiguous United States. We do not ship to Alaska, Hawaii, Puerto Rico, PO boxes, APO/FPO addresses, or outside the US.
We make cured meats and other perishable foods. Product photos are representative; because our products are handmade, weight, shape, and appearance vary from piece to piece. Listed weights are approximate unless stated otherwise. Nutrition and ingredient information is provided on each product page and on the label; if you have an allergy, read the label before eating.
An order is an offer to buy. We accept it when we send the order confirmation email, and we may decline or cancel any order before shipment, for example when a product is out of stock, a price or description was listed in error, or we suspect fraud. If we cancel, we refund you in full.
Prices are in US dollars and exclude shipping and sales tax, which are shown at checkout. Payment is processed by Stripe; we do not store your card number. We may correct pricing errors at any time, including after you have ordered, and will give you the choice to proceed at the correct price or cancel.
Our Shipping, Refunds & Returns Policy explains ship days, transit times, packaging, and what happens if a package arrives damaged or warm. Risk of loss passes to you when the carrier delivers the package to the address you gave us. We are not responsible for loss or spoilage after delivery, including packages left outside, taken from a porch, or delivered to an address entered incorrectly.
Because our products are perishable, we cannot accept returns. Refunds and replacements are handled under our Shipping, Refunds & Returns Policy.
You may order as a guest or create an account. You are responsible for keeping your password confidential and for activity on your account. Tell us at orders@tempestasalumi.com if you think someone else has used it.
Coupon codes are one per order unless we say otherwise, cannot be applied after an order is placed, and may be withdrawn at any time. Gift cards are not redeemable for cash except where required by law.
If you post a review or send us a photo, recipe, or comment, you give us a non-exclusive, royalty-free, perpetual license to use it on the Site and in our marketing, with your first name and last initial. Don’t post anything you don’t have the right to share, anything false, or anything abusive. We may remove content at our discretion.
The Site and everything on it, including our logos, photographs, recipes, product descriptions, and packaging designs, are owned by Tempesta or our licensors and protected by copyright and trademark law. Tempesta, Tempesta Artisan Salumi, ‘Ndujadella, and “How do you ‘nduja?” are trademarks of [LEGAL ENTITY], whether or not they appear with a trademark symbol. You may not use our marks, or anything confusingly similar, without our written permission. Other names and logos on the Site belong to their owners. You may share links to the Site and quote short excerpts with attribution.
These Terms cover retail purchases on the Site. Wholesale and foodservice orders are governed by separate written agreements. Contact sales@tempestasalumi.com for wholesale inquiries.
Except as expressly stated in these Terms or required by law, the Site and our products are provided “as is.” We disclaim all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose, to the fullest extent permitted by law. Some states do not allow these exclusions, so some may not apply to you.
To the fullest extent permitted by law, Tempesta’s total liability for any claim relating to an order is limited to the amount you paid for that order. We are not liable for indirect, incidental, special, or consequential damages. Nothing in these Terms limits liability that cannot be limited by law, including for personal injury caused by a defective product.
These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-law rules. If we can’t resolve a dispute informally, you agree that it will be heard in the state or federal courts located in Cook County, Illinois, and you consent to their jurisdiction. If any part of these Terms is found unenforceable, the rest remains in effect.
We may update these Terms from time to time. The date at the top shows the latest version; changes apply to orders placed after that date.
